Acceptance of Terms

By accessing or using CubistAI (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to any part of these Terms, please do not use the Service.

Description of Service

CubistAI is an AI-powered image generation and editing platform. The Service lets you:

• Generate images from text descriptions (text-to-image);
• Edit, restyle, upscale, or remove elements from images you upload (image-to-image);
• Choose from the AI models listed and disclosed on the pricing page.

Video generation is planned and will be activated on this platform once available; any video models we invoke will be disclosed on the pricing page before rollout. The specific AI models called by the platform, and the licensed third-party aggregation services through which they are integrated, are disclosed in the "Models & Data Sources" section of the pricing page.

We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where possible.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.

Payment, Subscriptions & Automatic Renewal

• Paid plans are billed in advance for the selected billing period (monthly or yearly) at the price displayed at checkout.
• Automatic renewal: Subscriptions renew automatically at the end of each billing period unless cancelled. You will be charged the applicable price for the next period using the payment method on file.
• How to cancel: You can cancel your subscription at any time by signing in and going to Settings → Billing/Subscription → Cancel subscription, or by contacting support at the email address provided on our website. There is no obligation to contact us first — cancellation is self-service.
• Cancellation takes effect at the end of the current billing period: you keep full access and your remaining credits until that period ends, and no further charges will be made afterwards.
• To avoid being charged for the next period, cancel at least 24 hours before the renewal date.
• You are responsible for providing accurate billing information. Unpaid or declined charges may result in suspension of access until the balance is settled.

Refund Policy

We want you to be satisfied with the Service. Our refund policy is as follows:

• 14-day money-back guarantee: If you are not satisfied, you may request a full refund within 14 days of your first payment for the current subscription, provided you have not consumed a substantial amount of the credits included in that plan (up to a reasonable threshold).
• Pro-rated refunds: After the 14-day window, refunds are granted on a case-by-case basis. If we approve a refund, unused credits may be refunded on a pro-rated basis.
• How to request a refund: Email us at the address provided on our website with the subject line "Refund Request", including your account email and order details. We respond within 3 business days.
• Processing time: Approved refunds are returned to the original payment method within 5–10 business days, depending on your bank or payment provider.
• Credits are non-transferable and have no cash value except as described above.

Acceptable Use & Content Policy

You agree to comply with our Acceptable Use Policy (the "AUP"), which forms part of these Terms. In particular:

• You must not use the Service to generate content that is sexual/NSFW, violent or gory, hateful, harmful to minors, deceptive (including deepfakes or impersonation), or infringing on third-party copyrights or trademarks. The six prohibited categories are detailed in the AUP.
• Real-person photos: If you upload photos of real people (e.g. for headshots, age filters, hair-color changes, cartoon avatars, or any image editing), you represent and warrant that the photos are your own likeness or that you have obtained the authorization of the person depicted (and, for minors, their parent or legal guardian) to use them. You must not upload photos of others without authorization.
• All generation prompts are subject to automated pre-generation safety scanning, including a built-in content filter and, when configured, a third-party prompt-safety scan. See the AUP for details on moderation, enforcement, and reporting.

Intellectual Property

The Service and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. AI models integrated into the Service are provided by their respective developers under their own licenses; nothing in these Terms grants you rights to those models.

Unless otherwise stated, you retain ownership of the images you generate and upload, subject to these Terms and the AUP.

Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or the AUP (including generating prohibited content), without refund except as required by law. You may close your account at any time through your account settings.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service.

Changes to These Terms

We may modify these Terms at any time. We will notify users of any material changes by updating the date at the top of this page and, where appropriate, sending a notice through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
